Terms of Service

These terms explain the conditions for purchasing and using FirstLead Systems services. Submitting an inquiry does not create a paid service agreement or authorize a charge. These terms were prepared by FirstLead Systems and have not been reviewed or approved by an attorney.
1. Acceptance of these terms
These terms apply when you purchase or use our paid services. Submitting an inquiry asks us to review fit and contact you; it is not a purchase and does not authorize a recurring charge. Recurring payment authorization occurs only when you complete checkout. If you do not agree, do not purchase or use the paid services.
2. Description of FirstLead Systems services
FirstLead Systems builds and maintains lead capture and automated response infrastructure for incoming inquiries. The FirstLead Starter System includes one branded lead page, one estimate form, one agreed lead destination, an owner alert, an optional customer confirmation, and setup and testing.
We provide technology and automation infrastructure. We do not sell lists of leads, and we do not act as your marketing agency unless agreed separately in writing. We do not guarantee jobs, sales, revenue, lead volume, or delivery speed.
3. Client eligibility and responsibilities
You must be at least 18 years old and authorized to enter into an agreement on behalf of your business. You agree to use our services lawfully and to provide accurate information about your business.
To deliver the service, we rely on you to supply, in a reasonable timeframe:
- Accurate business, service area, and contact information.
- Branding materials such as your logo, images, and copy.
- Any account access or permissions the setup requires.
- Timely approvals, feedback, and responses during setup.
Delays in providing these materials will delay delivery and are not our responsibility.
You are responsible for the accuracy of information and materials you provide, for having the rights and permissions to use them, and for following up with homeowners or other people who submit inquiries. We provide the infrastructure; we do not handle your sales conversations or customer service.
4. Setup and build fee
The one-time setup and build fee is $497 USD. The first $149 monthly service payment is also due at checkout after fit review, making the initial payment $646 USD. Setup work begins after payment. We then send a welcome email, complete onboarding and information review, build and test the system, request your approval, and launch after approval.
5. Monthly service and automatic renewal
The ongoing service fee is $149 USD per month. Monthly service starts at purchase and covers hosting of the agreed page, upkeep of the existing automation, periodic lead-flow checks, email support, and up to two minor content or form adjustment requests per month. Each request is limited to 30 minutes of work. Unused requests do not roll over. Repairs to the delivered setup are handled separately and do not reduce this small-change allowance.
The monthly service renews automatically each billing period until you cancel. When you complete checkout through Stripe, you authorize recurring charges to your selected payment method for the monthly service until cancellation. Prices may change over time; we will tell you before a change to your recurring fee takes effect.
6. Cancellation
You may cancel future recurring service at any time by emailing us at firstleadsystems@gmail.com. Please include your business name so we can identify your account. We will confirm the cancellation by email.
Cancellation stops future renewals and takes effect at the end of the current paid term. It does not automatically refund charges already incurred, except where required by law or where we agree otherwise.
7. What happens after cancellation
After cancellation takes effect, ongoing maintenance, monitoring, support, and any hosting or automation we provide as part of the monthly service will stop at the end of the paid period. Automated workflows we host may stop functioning at that point.
On request, we will make a reasonable effort to help you export your own business content and lead data before service ends.
8. Refunds
The $497 setup and build fee covers work we perform for you. Once substantial setup or build work has begun, that fee is generally non-refundable, except where required by law or where we agree otherwise in writing.
Monthly service fees pay for the upcoming service period and are generally non-refundable once the period has begun. If something goes wrong on our end, contact us — we would rather work it out with you than argue over a policy.
9. Failed or declined payments
If a payment fails or is declined, we may retry the charge and will contact you so the issue can be corrected. If payment remains unresolved, we may pause or suspend service until the account is current.
10. Suspension or termination
We may suspend or terminate service for non-payment, for abusive or unlawful use, or where continuing service would create a legal or security risk. Where reasonable, we will give notice and an opportunity to resolve the issue first.
11. Scope of maintenance and support
Monthly service includes the hosting, upkeep, checks, and limited adjustments described above. Support is provided by email. We do not offer 24/7 support or guarantee a specific response or resolution time, but we will address requests reasonably based on their impact and complexity.
It does not include new pages or redesigns, new integrations or automations, advertising, SEO ranking work, SMS, domain registration, additional paid third-party subscriptions, or unrelated technical work unless agreed in writing. Actual third-party usage costs require your advance approval and may be charged separately.
12. Third-party services
Our services depend on third-party platforms, which may include Stripe, Google services, Make, email delivery providers, hosting and database providers, and other APIs and platforms. Those providers operate under their own terms and privacy policies, and your use of them is subject to those terms.
Outages, pricing changes, policy changes, or feature changes made by those providers are outside our reasonable control. We will make a reasonable effort to restore or adapt the system when that happens.
13. No guarantee of results
We do not guarantee lead volume, sales, revenue, customer conversion, search engine rankings, or any specific business outcome. Results depend on your market, pricing, reputation, marketing, and how you follow up with leads.
14. Intellectual property and ownership
You own your business content and data: your logo, images, copy, business information, and the lead and customer records generated through your system. You confirm you have the right to use and share the materials you give us.
FirstLead Systems retains ownership of its name, branding, reusable systems, automation methods, templates, workflows, know-how, and underlying intellectual property, unless we agree otherwise in writing. You receive the right to use the system we build for your business while your service is active.
15. Acceptable use
- Do not use the website or our services for unlawful or deceptive purposes.
- Do not submit false information or someone else's details without consent.
- Do not send spam, malware, or automated abusive traffic.
- Do not attempt to access, copy, or disrupt systems or data you are not authorized to access.
16. Disclaimer of warranties
This website and our services are provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties such as merchantability and fitness for a particular purpose. We do not warrant that the service will be uninterrupted or error-free.
17. Limitation of liability
To the fullest extent permitted by law, FirstLead Systems is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost business opportunities, arising from use of this website or our services.
Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid us for the service in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited under applicable law.
18. Indemnification
You agree to indemnify and hold FirstLead Systems harmless from third-party claims arising out of content or materials you provide, your use of the services in violation of these terms, or your violation of applicable law.
19. Changes to services or terms
We may update our services and these terms as the business evolves. The revised version takes effect when posted here, and the "Last updated" date at the top of this page will reflect the change. Continued use of the website or services after an update means the current version applies.
20. Governing law
These terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-law rules.
